JUSTICE SANDEEP KUMAR ORAL ORDER 10-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Pandaul P.S. Case No. 05/2023, registered for the offence punishable under Sections 272, 273, 420, 120B of the Indian Penal Code and Sections 30(a), 32(i)(ii), 36, 41 (i) of the Bihar Prohibition and Excise Act, 2018.
Learned counsel for the petitioner at the very outset submitted that the petitioner is ready to deposit Rs. 1 Lakh in Ram Krishna Mission Sevashrama, Swami Vivekanand Path, Bela, Muzaffarpur, Bihar-842002. The petitioner is from Sonipat, Harayana. Petitioner carries five criminal antecedents other than the present one. Petitioner is in custody since 20.02.202.
Learned APP has vehemently opposed the prayer for bail.
Patna High Court CR. MISC. No.18668 of 2023(2) dt.10-05-2023 2/2 Petitioner has granted regular bail. Let the petitioner above named, be released on bail after framing of charge and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Pandaul P.S. Case No. 05/2023, corresponding to G.R. No. 65 of 2023.
Petitioner bail bond shall be accepted only after he produces the receipt of deposit amount issued by Ram Krishna Mission, Sevashrama, Swami Vivekanand Path, Bela, Muzaffarpur, Bihar-842002.
Since the petitioner is from Sonipat, (Harayana), the court below is directed to verify the recent address of the petitioner before releasing him and one of the bailor should be blood relative of the petitioner and he shall be released after framing of charge.
The verification process shall be initiated by court below just after the communication of the copy of this order to the court below.
