The petitioner seeks bail in a case registered for the offence under Sections 30(a), 36, 41(i) of Bihar Prohibition and Excise Act.

2250 liters of foreign liquor has been recovered from a truck and this petitioner was apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made on the confessional statement of driver of the said truck, who has already been granted bail by this Court, vide order dated 17.12.2021 in Cr.Misc. No. 49573 of 2021. Petitioner claims clean antecedent and he is in custody since 31.01.2022.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.18372 of 2022(2) dt.26-05-2022 2/2 Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise 2nd, Khagaria in connection with Maheshkhut P.S. Case No. 16 of 2021.
