The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420 of the IPC. It is alleged that this petitioner, in the name of providing government job, took Rs. 9,30,000/- from informant, but neither the petitioner provided job nor returned aforesaid amount to the informant.

Petitioner denies the prosecution case and submits that as a matter of fact, petitioner supplied medicines to the informant worth Rs. 11,39,894/-, but the informant has only given him Rs. 5,09,500/- and thus, Rs. 6,30,394/- is due upon the informant and when petitioner demanded rest of money, the informant lodged this false and concocted case. Moreover, to secure appointment through unfair means is unlawful and prohibited in law. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.19024 of 2023(2) dt.24-06-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya in connection with Vishnupad P.S. Case No. 298 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
