The petitioner seeks bail in a case registered for offences under Sections 30 (a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 378 litres of foreign liquor was recovered from the pickup van which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 19.08.2017.

Considering the facts and the circumstances of the

No.53418 of 2017(2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No. 864 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
