BADAR ORAL ORDER 03-01-2022 The applicant/accused in Crime No. 260 of 2020 registered with Nabinagar Police Station for the offences punishable under Sections 363 and 366A read with Section 34 of the IPC at the instance of first informant, Ramesh Singh, by this application is seeking release on bail during pendency of the trial.
Heard both sides.
The F.I.R. of the crime in question is registered at the instance of father of the victim female child. He averred that his minor daughter along with her minor female friend had been to Navinagar on 10.12.2020 but they both did not return. The first informant apprehended role of the present applicant and other co-accused in kidnapping both minor female children. During the course of investigation, both minor female
2/4 children are recovered by police. Their statement under Section 164 Cr.P.C. were recorded. One of the female child has stated to the Magistrate that she became friend with applicant Sanjeet @ Monu through Face Book and as seduced by him, she as well as her anther female friend left the house and joined the company of the applicant. She stated that she stayed at the house of one of the co-accused at the instance of the present applicant. The present applicant was making her to speak with her family members on her own sale phone. Her sale pone was snatched by the applicant. It is further averted by her that the applicant and his brother-in-law, i.e., co-accused, Sanjay were forcing her to marry with the applicant. However, she refused. Another victim female child has stated that she accompanied her female friend to join company of the present applicant where the coaccused, Sanjay, had outraged her modesty and insisted her to marry him.
Investigation of the crime in question is over. Both female child are recovered by police during the course of investigation. Co-accused, Sanjay, is directed to be released on bail vide Order dated 22.11.2021 by the Coordinate Bench of this Court in Cr. Misc. No.26885 of 2021.
In this view of the matter, the following order :-
3/4 i. The application is allowed.
ii. The applicant/accused, in Crime No.266 of 2020 registered with Navinagar Police Station for the offence punishable under Sections 363, 366A read with Section 34 of IPC, be released on bail on executing P.R. bond of Rs.10,000/- (Rupees Ten Thousand) on furnishing surety of the like amount to the satisfaction of the trial Court with the following conditions :- (I) The applicant should not contact the victim female children and her relatives as well as prosecution witnesses in any manner.
(II) The applicant/accused should not extend any threat, promise of inducement to the persons acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer. (II) The applicant/accused should cooperate the trial Court in expeditious disposal of the trial against him. (III) The applicant/accused should not contact the members of the prosecuting party as well as witnesses in this case in any manner till conclusion of the trial. (IV) The applicant should not repeat commission of similar offence in future and if he is found to be involved in
4/4 commission of similar offence, the State is at liberty to apply for cancellation of bail granted to the applicant in the instant case. The applicant to remove all office objections forthwith and Registry to issue bail-writ as per this order only after removal of office objections by the appellant/accused. (A. M.
