The petitioner seeks bail in a case registered under Sections 366/376 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the informant and of committing rape upon her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-12-2018. Charge sheet has already been submitted. The victim is Bhabi of this petitioner. There is no allegation of abduction. She eloped with the petitioner out of her own sweet will. She has already returned back with her children. She is residing with her husband.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 287 of 2018.
