The petitioner apprehends her arrest in Chandradeep P.S. Case No. 78/2012, registered for the offences punishable under Sections 315, 326, 417, 420, 471 of the Indian Penal Code. The informant, Incharge of PHC alleged in his written report that the petitioner and her husband are not MBBS doctors but they are treating different persons and doing surgery, even during course of delivery many ladies died.

It is submitted that the informant has not submitted any list of patients treated by the petitioner. The petitioner is not a doctor, she is simply running a nursing home as a Manager not as a doctor.

Considering the facts aforesaid and nature of

No.30859 of 2015 (3) dt.13-10-2015 2/2 allegation made against the petitioner and the petitioner is a lady, the petitioner above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Chandradeep P.S. Case No. 78/2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
