ANJANA MISHRA ORAL ORDER 31-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Learned counsel for the petitioner submits that the petitioner was arrest on 01.03.2018 and remanded on 04.03.2018 in connection with Magadh University P.S. Case No.24 of 2018 registered for the offence under 307 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the allegation that he had fired at the informant is wholly false and has been motivated by certain inimical forces.There is absolutely no motive for the petitioner to fire and had there been any motive, there would have been repetition of firing so as to attract the provisions of Section 307 of the I.P.C.

No.44504 of 2018 (2) dt.31-07-2018 2/2 Having heard learned counsel for the petitioner and learned counsel for the State and considering the fact that the petitioner has been in custody for almost five months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IX, Gaya in connection with Magadh University P.S. Case No.24 of 2018.
