Petitioner apprehends arrest in connection with Complaint Case No. 1168 of 2013 registered under Section420 of the Indian Penal Code and section 138 of the Negotiable Instruments Act.

Learned counsel for the petitioner submits that the dispute is purely civil in nature for that criminal prosecution is not warranted. Petitioner is still ready to make payment of the due amount.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation

Patna High Court Cr.Misc. No.37081 of 2016 (7) dt.20-06-2017 2/2 against this petitioner. Matter was referred to the Mediation Centre but the same failed.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
