Petitioner seeks bail in Bihariganj PS Case No. 108 of 2020 registered for the offences punishable under Sections 376, 302/34 of the Indian Penal Code and Section 4 of the POSCO Act.

Allegation against the petitioner is of committing murder of the minor daughter of the Informant by cutting her throat.

Considering the fact that there is direct allegation against the petitioner of killing the daughter of the Informant and from perusal of para 23 & 40 of the case diary in which petitioner himself has confessed his guilt, I am not inclined to enlarge the petitioner on bail.

Patna High Court CR. MISC. No.29127 of 2021(4) dt.21-10-2021 2/2 Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial Court is directed to expedite the trial and conclude the same within one year.
