Petitioner seeks bail in connection with Sadar P.S. Case No. 457 of 2017 for offences punishable under Sections 457, 380, 411/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that when he returned home at night he found some persons in his house and in the terrace. All persons managed to flee away while petitioner was found with gas cylinder and blood oozing from his head, who was apprehended and handed over to the police. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and no overt act has been committed by him, in fact, the petitioner is

Patna High Court Cr.Misc. No.51431 of 2017 (2) dt.06-11-2017 2/2 made accused on basis of suspicion and conspiracy and he is languishing in judicial custody since 25.08.2017. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on completion of three months in custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 457 of 2017, subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
