JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 23-06-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is aggrieved by the order of the SubDivisional Officer Marhowrah, District-Saran, whereby and whereunder he has cancelled the licence of the petitioner as well as the order of the District Magistrate, Saran at Chapra, who has confirmed the order of the Sub-Divisional Officer and dismissed the appeal on merit. Against the said order, the petitioner filed a Revision being Supply Revision No.70 of 2001-02, which has been dismissed for default.

Patna High Court CWJC No.4901 of 2016 dt.23-06-2017 Let the Supply Revision No.70 of 2001-02 be restored to its original file and the order of the Commissioner, Saran at Chapra is set aside. The petitioner is directed to pursue his remedy before the Commissioner, Saran at Chapra and remain present on the date fixed by the Commissioner. If the petitioner would remain absent without any reasonable cause, the Commissioner will be at liberty to pass appropriate order in accordance with law. With the aforesaid observations and directions, this writ application is disposed of.
