ANJANA MISHRA ORAL ORDER 06-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 26.04.2018 in connection with Bounsi P.S. Case No. 97 of 2018 registered for the offences punishable under Sections 302/307/120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that two persons were named as drivers of the vehicle which allegedly clashed leaving to the death of one S.I. Ram Lakhan Prasad. It is further submitted that only on speculation, the petitioner has been taken into custody and he has no criminal antecedent, at best, the case is one of Section 304(A) of the Indian Penal Code. In view of the aforementioned facts and circumstances and the nature of occurrence as described in the

No.44543 of 2018 (2) dt.06-08-2018 2/2 First Information Report, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Bounsi P.S.
