The petitioner apprehends her arrest in Chanan P.S. Case No.165 of 2018 registered under Sections 406, 409 and 420 of the Indian Penal Code.

The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 03.04.2019 passed in Cr. Misc. No.20624 of 2019.

The learned counsel for the petitioner submits that in sum and substance, the allegation is that the petitioner being the Secretary of the school and the Headmaster of Primary Middle School, Harvanspur withdrew Rs.16,13,700/- meant for construction of school building but no school building was constructed. Patna High Court CR. MISC. No.20102 of 2020(2) dt.23-06-2020 2/2 petitioner submits that petitioner is a lady and the Headmaster has already deposited the entire amount but I find no new ground. There is a serious allegation against the petitioner that the petitioner and the Headmaster of the school withdrew Rs.16,13,700/- in the financial year 2014-15 but the petitioner did not respond for four years nor constructed the school building.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
