JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioner is apprehending his arrest in connection with Birpur P.S. Case No. 105 of 2009 for the offence under Sections 363, 366A/34 of the Indian Penal Code. Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the informant's sister had been enticed away by the accused persons including the petitioner when she was going to attend tuition classes.
It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. From perusal of the statement made by the victim under Section 164 Cr.P.C., it is evident that the petitioner has not been named by the victim. On behalf of the State, it has been submitted that the petitioner is named in the First Information Report.
Patna High Court Cr.Misc. No.30626 of 2015 (2) dt.30-07-2015 Considering the aforesaid facts as the victim has not named the petitioner, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur (Supaul) in connection with Birpur P.S. Case No. 105 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
