The petitioner has been in custody since 14.12.2017 in connection with Aurai P.S. Case No. 117/2017 registered for the offences punishable under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is not named in the First Information Report, subsequently, on the basis of some information by spy, the name of the petitioner surfaced and consequently he was arrested and made to give a self confessional statement before the police which is now forming the basis of the prosecution. Learned counsel for the petitioner further submits that there has been no recovery from
Patna High Court Cr.Misc. No.44512 of 2018 (2) dt.10-08-2018 2/2 the petitioner and the self statement cannot form the basis of any prosecution as the same has no evidentiary value. Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 13th, Muzaffarpur in connection with Aurai P.S. Case No. 117/2017.
