The petitioners are apprehending arrest in connection with Punaura P.S. Case No. 157 of 2019 registered for the offence under Sections 147, 149, 199, 353 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.17658 of 2020(3) dt.30-09-2020 2/2 would submit that the petitioners have no criminal antecedent. Referring to the prosecution case learned counsel submits that on 2.10.2019 one Rakesh Kumar was done to death by unknown criminals. The news of death of Rakesh led to protest and a large number of persons blocked NH 104 and in the aforesaid background these petitioners have been made accused in this case. There is no specific allegation against these petitioners. They are only members of the mob. Considering the aforesaid, the Court is inclined to grant bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within one month from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Punaura P.S. Case No. 157 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.
