The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a)/37(b) (c) of the Bihar Prohibition & Excise Act, 2016. Allegation is recovery of 15.400 litres Mahua wine from the house of the petitioner.

It has been submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent.

Allegation is recovery of 15.400 litres wine from the house of the petitioner, as such, anticipatory bail application is not maintainable and is accordingly dismissed. However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on the
