Petitioner apprehends his arrest in a case registered under section 498(A) of the Indian Penal Code. Allegation against the petitioner is of causing cruelty to the complainant for the demand of dowry and also of ousting her from her matrimonial home after snatching her ornaments and clothes.
On behalf of the petitioner and counsel for the informant it has been submitted that both the parties have agreed to live together.
Considering the aforesaid submission the above
Patna High Court Cr.Misc. No.29564 of 2015 (2) dt.28-07-2015 2/2 named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri Sanjeev Kumar-III, J.M. Ist Class, Siwan in Complaint Case No. 3143 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C.
It is directed that both the parties should appear before the court below and the court below will ensure that both have agreed to go together and in case if the petitioner decline to take her, in that case petitioner shall be liable to deposit Rs. 1500/- per month in the court below which shall be released in favour of the informant.
