JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 324, 341, 380, 447, 504/34 of the Indian Penal Code. It is alleged that F.I.R named accused persons including the petitioner came variously armed, made assault and started abusing and on protest being made by minor son of the informant namely Abdul Kalam then it is specifically alleged that this petitioner assaulted with farsa on the head of the son of the informant.

It is submitted by learned counsel for the petitioner that two incised injuries were found caused by sharp cutting weapon, simple in nature.

Considering the fact that there is specific accusation of assault against the petitioner, this court is not inclined to grant anticipatory bail of the petitioner.

Patna High Court Cr.Misc. No.31773 of 2015 (2) dt.06-08-2015 2/2 Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Pratapganj P.S. Case No. 10 of 2014, pending in the Court of learned SubDivisional Judicial Magistrate, Birpur, Supaul. Accordingly the application is disposed off.
