By filing the instant application under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the first information report of Vaishali (Hazipur) SC /ST P.S. Case No. 193 of 2011 registered for the offences punishable under Sections 120B, 406 and 420 read with 34 of the Indian Penal Code as well as Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act, 1989.

The allegations made in the FIR do constitute a

Patna High Court Cr. WJC No.570 of 2014 dt.06-02-2015 2 / 2 cognizable offence.

In that view of the matter, I am not inclined to accede to the prayer made on behalf of the petitioner. Accordingly, the application is dismissed.

This order shall not, in any way, prejudice the defence of the petitioner in the Court below.
