Petitioner seeks bail in a case registered for the offence punishable under Section 396 of the Indian Penal Code. The petitioner is in custody since 11.05.2017 in a case wherein FIR has been registered against unknown regarding an occurrence of dacoity with murder.

Submission is that the petitioner was never put on TIP and the household articles said to be recovered from the house of the petitioner was never put on TIP to establish that the same was looted property.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.59358 of 2017 (3) dt.05-02-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Buxar (Muffasil) Police Station Case No. 294 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
