2. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of occurrence, while the grand-daughter of the informant was going to school, on the way, co-accused Sanjay Pal misbehaved with her and tried to outrage her modesty and also threatened her. When her family members went to the house of Sanjay Pal, petitioner no. 3 ordered to kill the
Patna High Court CR. MISC. No.19737 of 2023(3) dt.13-07-2023 2/2 informants side. Thereafter, co-accused Sanjay Pal gave iron rod blow to Shanti Devi due to which she sustained injury on her head. Petitioner nos. 1, 2 and 3 also assaulted Shanti Devi with danda, as a result of which her hand got fractured. Petitioners claim clean antecedents.
4. It is submitted that though there is allegation of commission of assault against all the three accused persons, but only one injury has been found by the doctor. Petitioners claim clean antecedents.
5. Considering the facts aforesaid, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Sasaram, Rohtas in connection with Chenari P.S. Case No. 263 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
