The petitioners are apprehending their arrest in a case registered under Sections-147, 148, 149, 341, 323, 353, 307, 427, 288, 290 of the Indian Penal Code and Sections-30 & 45 of the Bihar Prohibition and Excise Act.
The prosecution case, in short, is that on secret information, the informant along with others reached the place

No.19112 of 2023(2) dt.10-05-2023 2/3 of occurrence and saw that 100-150 unknown persons have blocked the road and in consequence thereof, the police constables were attacked as a result of which, they sustained injuries. It is also alleged that two arrested persons were found in drunken state.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. A scuffle had taken place between the police party and the local residents. The petitioners are said to be members of unlawful assembly. It is further alleged that the petitioners were found in drunken state. There is no recovery of any liquor. The injury is said to be simple in nature. No offence under Section-307 of the Indian Penal Code is attracted in the present case. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of
