2. The petitioner seeks bail in connection with Araria P.S. Case No. 968 of 2023 registered for the offence punishable under Sections 8 and 21(b) of the N.D.P.S. Act.

3. As per the prosecution case, 75 gms. smack has been recovered. Money has also been recovered.

4. There is no recovery from the possession of the petitioner. The name of the petitioner has come in the confessional statement two co-accused from whom recovery has been made who have been granted bail by this Court. The petitioner is in jail since 05.01.2024 having clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the fact that the recovery is of intermediate quantity, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Araria in connection with Araria P.S. Case No. 968 of 2023.

8. The petitioner will also mark attendance in Araria Police StationAraria on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U
