JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,506 and 307 of the Indian Penal Code. Later on Section 302 IPC was added.
It is alleged that all the accused persons including the petitioners caught hold of the husband of the informant when co accused Tetar Kewat assaulted on the head of the father of the informant causing bleeding injury.
It is submitted by the learned counsel for the petitioners that specific accusation of assault is against co accused Tetar
Patna High Court Cr.Misc. No.29847 of 2015 (2) dt.28-07-2015 2/2 Kewat. The injury report reflects only one injury on the scalp though the postmortem reflects multiple injuries including two superficial injuries. It is further submitted that considering the overt act against co accused Tetar Kewat, co accused Kaushalya Devi has been granted anticipatory bail vide Cr. Misc. No. 29632 of 2014. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Hilsa in connection with Khudaganj P.S. Case No.18 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
