In this case, the petitioner is challenging the order of Sub Divisional Officer, Barsoi as contained in Memo No. 29 dated 29.2.2016, whereby and whereunder, he has cancelled the licence of the petitioner.
There is an alternative remedy to the petitioner by way of filing an appeal.
Learned counsel for the petitioner submits that he may be given liberty to file an appeal before the appellate authority. Accordingly, this application is disposed of with a liberty
Patna High Court CWJC No.18815 of 2016 dt.20-06-2017 to the petitioner to file an appeal.
If an appeal is filed by the petitioner within a period of three weeks from today, in such circumstances, the appellate authority will decide the case within a period of three months from the date of filing of the appeal.
The appellate authority, while considering the question of limitation, will take into consideration the pendency of this application before this Court.
