The petitioner, who is in custody, seeks bail in connection with Dholbajja P.S. Case No. 61 of 2017 registered for the offence punishable under Sections 341, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959. Petitioner is the full brother of informant and allegation against the petitioner is that while the informant was coming to his home by his motorcycle, three persons fired upon him from behind and he sustained pellet injury on thigh. The injury report has been enclosed as Annexure-2 accordingly to which the nature of injury is simple. It has been further contended that petitioner is a teacher and innocent and has implicated in this

Patna High Court Cr.Misc. No.58018 of 2017 (3) dt.11-01-2018 2/2 case only due to property dispute in the family. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 30.10.2017 and alleged FIR was lodged after two days of occurrence.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Naugachia, Bhagalpur, in connection with Dholbajja P.S.
