JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 20-06-2017 The grievance of the petitioner is that although Gram Panchayat Raj, Madhavpur falls in Ward No.6 but in the advertisement published for appointment of Anganbari Sevika/Sahayika by the District Magistrate, Khagaria Gram Panchayat, Madhavpur has been shown as falling under Ward no.4 and which disqualifies the petitioner for making application for appointment to the post of Anganbari Sevika, Centre No.3, Rayji Tola, Gram Panchayat Raj, Madhavpur in the district of Khagaria. According to Mr. Amish Kumar, learned counsel appearing for the petitioner, the earlier appointments were made in reference to centre no.

3 situated in Ward No.6 but the Advertisement present at Annexure-5, for no apparent reason, allocates the centre to Ward no.4 and which has prejudiced the petitioner from applying for such appointment. It is the case of the petitioner that the Anganbari Centre No.

Patna High Court CWJC No.18431 of 2016 dt.20-06-2017 No.6 but has been incorrectly shown under Ward no.4. Although Mr.

Amish Kumar, learned counsel appearing for the petitioner has invited the attention of this Court to a representation placed at Annexure-6 which is addressed to the Secretary, Social Welfare Department, Government of Bihar, Patna but in the circumstances where the advertisement in question is issued by the District Magistrate, Khagaria, the appropriate authority in the present case to consider the grievance of the petitioner would be the District Magistrate, Khagaria and accordingly the writ petition is disposed of with a liberty to the petitioner to file a representation before the District Magistrate, Khagaria raising her grievance and which shall be considered and disposed of by the District Magistrate, Khagaria in accordance with law within a period of three months from the date of receipt/production of a copy of this judgment.

Needless to add that the District Magistrate, Khagaria while disposing of the representation of the petitioner would bear in mind the selection process already initiated in the matter. The writ petition is disposed of accordingly.
