JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 08.03.2022 and is a person with clean antecedent.
Allegation is of recovery of 99 litres of liquor from the place of occurrence.
Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the alleged recovery was made from outside the house of the petitioner as such petitioner was completely
Patna High Court CR. MISC. No.18500 of 2022(2) dt.15-04-2022 2/2 unaware who had kept the liquor near his straw house. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Basantpur (Lakari Nabiganj O.P.)
