====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 08-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Udwant Nagar (G) P.S. Case No.361 of 2023 for the offences registered under Sections 304(B)/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that this is the second bail petition on behalf of the petitioner. Earlier, the petitioner had withdrawn the bail petition with liberty to file the same afresh, if required after six months. He further submits that the trial has not been concluded till date. Petitioner is in custody since 28.08.2023. He submits that petitioner shall co-operate in the trial.
4. Learned counsel appearing on behalf of the State vehemently opposes the prayer for grant of bail to the petitioner
Patna High Court CR. MISC. No.20980 of 2025(4) dt.08-08-2025 2/2 and submits that the defence evidence has been closed and the case is already been fixed for argument and judgment in this case is likely to be pronounced, therefore, the bail petition of the petitioner is liable to be rejected at this stage.
5. The fact that the case is fixed for argument and judgment is likely to be pronounced has also been corroborated by the report of the learned Trial Court.
6. Having considered the facts and circumstances of the case and submission made on behalf of the parties, this Court is not inclined to grant bail to the petitioner. Accordingly, the bail petition of the petitioner is dismissed. (Sunil Dutta Mishra, J) Ritik/- U T
