For the Petitioners :
Mr. Sanjay Kumar Singh, Advocate For the State :
Mr. Shailendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.
3. As per F.I.R., informant alleged that on 04.06.2024, he got information that his sister, namely Rani Devi, was traceless from her Sasural. It is further alleged that after getting information, informant reached Sasural of his sister and got knowledge that all the accused persons named in the F.I.R., including these petitioners, committed murder of his sister.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.17631 of 2025(4) dt.23-07-2025 2/3 behalf of the petitioners that petitioners are innocent and have committed no offence. Petitioners have falsely been implicated in this case merely because Petitioner No. 1 happens to be father-in-law and Petitioner No. 2 happens to be mother-in-law of the deceased. Petitioners are victim of over implication. Informant is not an eye witness of the occurrence. Petitioners are separate in mess & property and have got no concern with the affairs of the deceased and her husband. It is further submitted that marriage of sister of informant was solemnized with son of these petitioners, namely Santosh Paswan, about 12 years ago and they have been blessed with four children which amply demonstrates that both the couples were leading happy conjugal life without any complaints. As a matter of fact, the victim was suffering from illness and died during course of treatment. Petitioners claim clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they, along with other accused persons, committed murder of sister of informant. The husband of deceased was living out of station and in such situations, the deceased has been killed by these petitioners and
Patna High Court CR. MISC. No.17631 of 2025(4) dt.23-07-2025 3/3 her dead body has been disposed of without knowledge to her husband and other relatives.
6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
