Having regard to the nature of allegation against the petitioner for offence under Section 341, 323, 307, 354, 379, 504 & 498(A), this Court would not be inclined to grant privilege of anticipatory bail only because of conduct of the petitioner to be wholly inhuman, inasmuch as, even if there may be any sort of differences between him and his brother, he had no reason to assault his Bhabhi, who was carrying a pregnancy of five months. The submission of the learned counsel for the petitioner that no such injury is reflected again has to be only noted for its being rejected, inasmuch as, the Sessions Judge in paragraph no.5 of the order has clearly recorded the injuries on the person of the victim lady which would definitely go to show that she was subjected to assault led by the petitioner who had hit her in her stomach.

No.36862 of 2014 (2) dt.09-04-2015 Be that as it may, this Court is not inclined to grant anticipatory bail to the petitioner and, therefore, while rejecting the prayer for grant of anticipatory bail of the petitioner, namely, Sukendra Singh @ Sukindra Singh, all that can be said is that if the petitioner surrenders before the court below, the prayer for regular bail would be considered on its own merit without being prejudiced by anything said in this order.
