The petitioner seeks anticipatory bail in Jamalpur P.S. Case No.100 of 2018 instituted for the offences under Sections 450, 376, 511, 379, 504, 506, 34 of the Indian Penal Code. It has been alleged that petitioner aged about 29 years was hiding himself on the top of the house at 10:30PM. When the daughter of informant was in the kitchen, he sneaked in the kitchen and gagged her mouth and dragged beneath to the stair case and tried to outrage the modesty.
Learned counsel for the petitioner submits that petitioner was brutally assaulted on account of dispute regarding settling of tank and he was admitted in the hospital which is apparently
Patna High Court Cr.Misc. No.43227 of 2018 (2) dt.23-07-2018 2 /2 clear from Annexure 3 and the statement was recorded by the police on the same day and lodged a case.
As per First Information Report allegation has been made that he has entered into the house of the informant in the late night, certainly he must receive the injury from the informant. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected.
