2. The petitioner seeks bail in a case initially registered for the offence punishable under Sections190/191(2)/126(2)/115(2)/117(2)/109/324(4) of B.N.S. and later on, Section 103(1) of B.N.S

3. Allegedly, on the date of occurrence, the accused persons including the petitioner having armed with Khanti, stick etc. came at the door of the informant and started abusing her husband. On protest, the accused persons attacked on her husband and in that course, co-accused Munni Yadav is said to have given iron rod blow on the person of informant's husband as a result of which, he sustained injury and was carried to Sadar Hospital, Nawada and thereafter, the doctor referred him to Pawapuri and lastly, he was referred to Patna where in course of treatment, husband of the informant died.

4. It has been submitted on behalf of the petitioner that the allegation of inflicting Khanti blow on the head of the deceased is against co-accused, Munni Yadav. So far the present petitioner is concerned, there is general and omnibus allegation against him. On exactly similar footing, the co-accused, Pintoo Kumar has been granted anticipatory bail.

5. On the otherhand, Mr. Shailendra Kumar, learned APP has opposed the prayer for bail.

6. It appears that the specific allegation of inflicting Khanti blow on the head of husband of the informant is against coaccused Munni Yadav and on similar footing, one co-accused Pintoo Kumar has been granted anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nemdarganj P.S.
