The petitioner is apprehending his arrest in a case instituted under Sections 143,323,324,325,307,379,504 and 506 of the Indian Penal Code.

The prosecution case, in short, is that the petitioner along with other accused armed with deadly weapons intercepted the informant and brutally assaulted him.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Annexure-2 is the injury report, which indicates that the injury is simple in nature and, therefore, no offence under Section 307 of the Indian Penal Code is being made out against the petitioner.

Patna High Court Cr.Misc. No.28632 of 2015 (3) dt.01-10-2015 On behalf of the State, it is submitted that the petitioner is named in the first information report. Let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Birpur (Supaul) in connection with Karjain P.S. Case No.17 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
