JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2018 Earlier prayer for bail of the appellant was rejected vide order dated 10.10.2017 passed in Cr.Appeal(SJ) No. 2614 of 2017 with an observation to renew his prayer for bail after framing of charge.

Submission of learned counsel for the appellant is that though there is allegation of assault by sword and opinion of injury was kept reserved but the report has not been submitted till date and appellant is in custody for ten months and charge has been framed.

Heard learned Special P.P. also.

Having heard both sides and in the facts and circumstances, the appeal is allowed and the impugned order dated 30.10.2017 passed by learned Additional District Judge-I, Jamui is

Let the appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-I, Jamui, in connection with SC/ST Case No. 123 of 2017, arising out of Chandramandih P.S.Case No. 01 of 2017, subject to the conditions that (1) one of the bailors shall be local person having sufficient immoveable property in the jurisdiction of court concerned and (2) appellant shall co-operate in trial and appear in court as and when required, except on genuine reason, failing which his bail bond shall be cancelled.
