JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioners apprehend their arrest in connection with Vidyapati Nagar P.S.Case No. 07 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of in total 20 litres of country made liquor from the house of the petitioners. Submission of learned counsel for the petitioners is that petitioners have falsely been implicated in this case and furthermore they have no criminal antecedent and they are ready to abide by any condition.

Having heard both sides and in the facts and

Patna High Court CR. MISC. No.22284 of 2019(2) dt.08-04-2019 2/2 circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III-cum-Special Judge, Excise, Samastipur in connection with Vidyapati Nagar P.S. Case No. 07 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that if he is found directly involved in such type of cases, prosecution will have liberty to move before the court below for cancellation of his bail bonds.
