2. In this case, the petitioner is seeking regular bail in connection with S.Tr. No. 42 of 2025 arising out of Hajipur Town P.S. Case No. 708 of 2023, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per allegation, unknown criminals have killed the deceased. During investigation, the entire modus operandi of the criminals have came.

4. Learned counsel for the petitioner has submitted that the petitioner name has figured in confessional statement of co-accused, Ashok Kumar and Chanchal Sah and in their

Patna High Court CR. MISC. No.17505 of 2025(3) dt.13-05-2025 2/2 respective confessional statements, they have stated that Chanchal had fired shot on the deceased and thereafter coaccused Rudal and Raushan also fired over him. So far as the petitioner is concerned, there is no specific role assigned to him. It has been only mentioned in the confessional statement of coaccused persons that the petitioner was present in a car at the time of occurrence. The petitioner is under custody since 08.10.2024.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-IX, Vaishali at Hajipur in connection with S.T. Case No. 42 of 2025 arising out of Hajipur Town P.S. Case No. 708 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
