JUSTICE SANJAY KUMAR ORAL ORDER 23-07-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks regular bail in connection with Laheri P.S. Case No.112 of 2018 registered for the offences punishable under Sections 420, 356, 379, 411/34 of the Indian Penal Code.
As per the F.I.R. when the informant was withdrawing money from A.T.M, this petitioner on the pretext of helping the informant took his A.T.M. Card and on protest the petitioner changed the A.T.M. Card of the informant and on alarm the petitioner gave a plain A.T.M. Card to the informant and started fleeing away. This petitioner was caught after some chase. Patna High Court Cr.Misc. No.37021 of 2018 (3) dt.23-07-2018 implicated with false and frivolous allegation. He was apprehended merely on suspicion. The petitioner is in custody since 07.05.2018 having clean antecedent and so he deserves bail. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Laheri P.S.
