20-11-2017 Heard Sri Satish Chandra, learned counsel for the petitioner and Sri Jai Narain Thakur, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 17-06-2017, in Masaurhi P.S. Case No. 501 of 2016 registered for offence under Sections 457, 380, 411 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case and he has been made accused on confessional statement of coaccused, which was made before the police. He submits that save and except confessional statement, there is no other material to connect the petitioner.

No.55449 of 2017(3) dt.20-11-2017 2/2 Considering the nature of accusation as well as the fact that petitioner's name has come only on confessional statement of co-accused that too made before the police and no other material has been shown showing his implication, there is no reason to refuse the prayer for bail of petitioner. Let the petitioner namely Sunny Kumar @ Sanni Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi in connection with Masaurhi P.S. Case No. 501 of 2016.
