2. This is the 3rd attempt for bail of the petitioner as earlier such prayer for bail was rejected by this Court vide order dated 22.05.2023 passed in Cr. Miscellaneous No. 60828 of 2022 and vide order dated 03.05.2024 passed in Cr. Miscellaneous No. 15005 of 2024.

3. The petitioner seeks bail in connection with Benipatti P.S. Case No. 67/2021, registered for the offence u/ss 147, 148, 149, 341, 323, 324, 325, 326, 307, 302 and 120B of the Indian Penal Code.

4. In a case of five murders, the trial is being delayed by the prosecution. In the trial, out of 30 charge-sheeted witnesses, 10 prosecution witnesses have been examined. The petitioner and others are accused of committing five murders.

5. Considering the gravity of offence and the allegation levelled against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Superintendent of Police, Madhubani is directed to ensure the appearance of the witnesses in the trial on each and every date.

8. Mr. Jharkhandi Upadhyay, learned APP will communicate this order to the Superintendent of Police, Madhubani. A copy of the brief be handed over to Mr. Jharkhandi Upadhyay, learned APP by learned counsel for the petitioner.
