JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2018 This has come under the heading 'To Be Mentioned' at the instance of learned counsel for the petitioners stating that wrong order dated 13.9.2018 has been communicated to the court below.

In such view of the matter, the correct order dated 13.9.2018 is as follows :

Heard the parties.

Petitioners seek bail in Masrakh P.S.Case No. 151 of 2018 registered for the offences under Sections 147, 149, 341, 323, 324, 307 and 504 of the I.P.C.

Allegation against the petitioners is of assault to the informant and others.

Submission of learned counsel for the petitioners is that there is case and counter case and injuries are simple in nature except one injury. Petitioners are in custody since 17.5.2018.

Patna High Court Cr.Misc. No.46333 of 2018 (4) dt.26-09-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Masrakh P.S.Case No. 151 of 2018, subject to the conditions that (i) one of the bailors must be a local person having sufficient immoveable property within the jurisdiction of the concerned court, (ii) the petitioners will not induce any witness or tamper with the evidence and the petitioners shall co-operate in the disposal of the case and make them available as and when required by the court, otherwise the prosecution is free to move for cancellation of their bail bonds. The Secretary concerned is warned to be careful in future.

Let this order be communicated to the court concerned forthwith.
