JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.5.2018, seeks bail in Jehanabad Mahila PS Case No. 3 of 2018 registered under Sections 341, 342, 376 and 511/34 of the IPC.
The allegation in brief is that while the informant's daughter had gone to bring water from the hand-pump, all the accused persons dragged her in a school and made an attempt to rape but she escaped. Learned Counsel for the petitioner seeks bail of the petitioner on the ground of parity as another co-accused similarly situated namely Laxman Manjhi has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 39358 of 2018. Having considered the said facts and circumstances, the petitioner, namely, Upendra Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst -cum- Special Judge, Jehanabad in connection with Jehanabad Mahila PS Case No. 3 of 2018.
