08-01-2015 Heard learned counsel for the petitioner, Sri Anjani Kumar Sharan, learned Central Government Counsel as well as Sri Kaushlendra Kumar Sinha, learned counsel, who has appeared on behalf of Respondent/State Bank of India.

The present writ petition has been filed with a prayer to direct the authority to make payment of 60 % differences of pension due to implementation of 6th Pay Commission Report and other reliefs.

Patna High Court CWJC No.682 of 2014 (6) dt.08-01-2015 2/2 The petitioner retired on 31.07.2007 as Inspector, C.R.P.F., Ahmadabad.

In this case, a detailed counter affidavit has been filed on behalf of Respondent nos. 1 to 7/ Union of India, wherein it has been indicated that immediately after retirement of the petitioner, pension was fixed and all retiral dues were settled. Even from time to time pension were revised. Regarding claim of 60 % of difference of pension, a specific stand has been taken in paragraph-8 of the counter affidavit that firstly payment of 40 % was made in the year 2008 and thereafter remaining 60% was paid on 14.12.2009. Even death-cum- retirement gratuity amount i.e. Rs.2, 17,182/- was paid long back on 15.10.2007. In view of facts and circumstances, the Court is of the opinion that all the claimed reliefs have already been granted. The petition stands dismissed.
