JUSTICE ARVIND SRIVASTAVA ORAL ORDER 15-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Kesariya P.S. Case No. 42 of 2016 registered for the offence punishable under sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code and section 138 of the Negotiable Instruments Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The accused nos. 1 & 2 named in the first information report were known to the informant. Sanjay Rana proposed the informant to become partner in the Brick Industries which is running in the name of his brother Ranjit Singh. The alleged agreement was entered into between Sanjay Rana and the present informant and petitioner is only alleged to be a witness of the said agreement. In this case cheques were also issued by the said Sanjay Rana.
Patna High Court Cr.Misc. No.49431 of 2017(3) dt.15-12-2017 2/2 Petitioner has no concerned with the alleged offence. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, XI, East Champaran, Motihari in connection with Kesariya P.S. Case No. 42 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
