2. In this case, the petitioner is seeking regular bail in connection with Laukahi (Narhaiya O.P) P.S. Case No. 202 of 2023, registered for the offences punishable under Sections 363, 366(A), 34, 376(3) of Indian Penal Code, Section 4 of POCSO Act & Section 9 of Prohibition of Child Marriage Act.

3. As per allegation, the daughter of the informant had gone to get her certificate, but she did not return. Thereafter, the informant started searching for her and he came to know that her minor daughter was kidnapped by the petitioner and two other persons.

4. By drawing my attention towards the paragraph no.

Patna High Court CR. MISC. No.20128 of 2024(5) dt.01-07-2024 2/2 56 of the case diary, the learned counsel for the petitioner has submitted that the Medical Board has found the age of the victim above 19 years and she, in her statement recorded under Section 164 of the CrPC which is annexed with the record, did not make any allegation against the petitioner rather she has specifically stated that she went with the petitioner as per her own sweet will.

5. On the other hand, learned APP, Shri Shailendra Kumar has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District JudgeVII-cum-Special Judge (POCSO Court) Madhubani in connection with Laukahi (Narhaiya O.P) P.S. Case No. 202 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
