2. The petitioner is an accused in connection with Dhansoi P.S. Case No. 127 of 2022 registered for the offences under sections 363 and 366(A) of the Indian Penal Code lodged on 14.09.2022 by the informant, Premchandra Choudhary.

3. As per the prosecution story, the informant alleged that his sister was traceless since last two days and on search, she could not be found. He had strong belief that Sugriv Choudhary and Babudhan Choudhary has abducted her. Accordingly, the FIR.

4. Learned counsel for the petitioner has taken this Court to the deposition made by the victim girl before the learned Trial Court to show that she has completely denied the allegation made in the FIR and during the cross examination

Patna High Court CR. MISC. No.21337 of 2026(2) dt.03-04-2026 2/3 narrated that she went to Ajmer on her own and later returned. He further submitted if granted relief, the petitioner shall be diligently appearing in trial.

5. Learned APP opposes the prayer submitting that the victim girl had earlier supported the prosecution story. Further submission is that similar placed co-accused Sugriv Chaudhary has been granted bail in Cr. Misc. No. 43993 of 2024 by a coordinate bench.

Taking into account the aforesaid facts as also that he is in custody since 27.12.2022 having no criminal antecedent, the victim girl in her deposition has not supported the prosecution story, an undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.

6. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge POCSO, Buxar, in connection with Dhansoi P.S. Case No. 127 of 2022 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Driving License/Voter ID/Pan Card

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance and at the end of the period a certificate be submitted before the Trial Court failing which the State shall be at liberty to take steps for cancellation of bail bonds; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
