JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 356 of 2013, in which, cognizance has been taken under Sections-498(A)/34 of the Indian Penal Code and Section-4 of Dowry Prohibition Act.
The petitioner is husband of the complainant and there appears to be allegation of torturing against him. The impugned order of learned Sessions Judge reflects that the learned Sessions Judge took pain to patch up the dispute of the parties but the petitioner flatly, refused to lead his conjugal life with the complainant and also made allegation of adultery against the
Patna High Court Cr.Misc. No.39526 of 2013 (2) dt.24-12-2013 2/2 petitioner.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to extend the privilege of bail to the petitioner and, accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) A.K.V./-
