The petitioners, three in number, apprehend their arrest in a case under Sections 307, 379, 324 and other sections of the Indian Penal Code.

The informant named the petitioners and alleged that Shrawan Yadav (petitioner no. 3) assaulted him with Farsa and other accused persons assaulted him with iron rod and stick. It is submitted that there is a counter-version being Ashok Paper Mill PS Case No. 176/2013. The occurrence took place due to land dispute for putting a pole on the land. Ram Narayan Yadav, the informant, got four injuries but the injuries are lacerated wound and abrasion. One injury was found on the forehead. All the

Patna High Court Cr.Misc. No.27843 of 2015 (2) dt.22-07-2015 2/2 injuries are opined to be simple in nature. Radha Devi (petitioner no. 1) got one grievous injury, but the accused of the counter case has already been granted anticipatory bail.

Considering the facts aforesaid and the fact that on account of land dispute the occurrence took place and the informant got simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in A.P.M. P.S. Case No. 164/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
